Terms and Conditions & Rental Agreement

Through the Services, we aim to give you access to beautiful designer clothing and accessories, and stylist advice and other content to help you decide which items are perfect for you.

Definitions

In these Terms of Use “you” and “your” refer to all users of this Website and “we’, “us” and “our” refer to Rent My Dress Pty Ltd. References to users must be read as being also a reference to customers of Rent My Dress Pty Ltd

LEGALLY BINDING Contract.  

These Terms of Use constitute a binding legal contract between you and Rent My Dress Pty Ltd. These Terms of Use apply to you whether you are browsing or are a customer of Rent My Dress Pty Ltd. The Terms of Use in force at any time are published on this Google Document and you will be taken to have accepted them by booking a dress through Instagram with Rent My Dress Pty Ltd.  If Rent My Dress Pty Ltd develops revised terms of use then on this Google Document they will supersede those they replace. If you subsequently rent a dress you will be taken to have accepted the revised terms of use. If you do not agree with the terms of use do not dress a dress from Rent My Dress Pty Ltd.  These Terms of Use may change without notice, so do check from time to time. If you do not agree to any change, you should not rent a dress from us. 

This agreement contains all of the terms and conditions regarding your rental of products from Rent My Dress Pty Ltd via Instagram and accompanying booking platforms. You agree that rental from our business is subject to all terms and conditions and privacy policy. These are available via this Google Document and are subject to change from time to time. You agree that you are renting products and ownership of the product remains with Rent My Dress Pty Ltd at all times. 

 

Our Commitment to you

We will deliver the product that you have ordered including the correct size, colour, and style on or before the date you have specified for delivery on your order. Except where we have indicated to you that your request for this is not possible or guaranteed and therefore your order has been amended. Products may appear different in colour and style then the images listed on our Instagram. Our liability to you for failure to deliver a product you have ordered is limited only to timely delivery.

Garment

Please note this is a rental/hire company. Not every single item we have is in brand new condition as it may have potentially been worn my someone previous to you. When you hire you should be aware that there may be small signs of wear.

Item not able to be worn.

If you receive an item and it is completely unwearable (backed up by photo evidence) you are entitled to a full refund, NOT including the shipping price.

Rent My Dress Aus will provide you with a refund when the item you have rented, but NOT worn, is back in our hands.

If you contact us about your unwearable item and do not send the dress back that day  in the return satchel provided, we will assume you have still worn the dress and will not offer a refund you for this. it must be sent back that day and not kept.

Payment Terms

The “rental fee” for the products will be the rental fee, dry cleaning fee and delivery fees and any additional charges discussed in relation to your rental of products. When you rent a dress from Rent My Dress Pty Ltd payment options include - bank transfer , paypal or cash.  In addition to your rental order for a product, a bond is required on all items.

Product Fit and Returns

If a product doesn’t fit you then you can return it unworn within 24 hours to receive a credit of the rental fee minus delivery charges. You must instagram DM @rentmydressaus indicating your intention to mail back the product for credit. The term “unworn” will be determined by Rent My Dress Pty Ltd and must be fulfilled prior to a credit being issued. Credits will only be issued if ALL of the sizes in the order were unworn.

if you want to put it in the yellow express post box you will be liable if it doesn't get  scanned and if we don't receive it back and have no proof it was sent you will be liable to pay the full amount of the outfit!  PLEASE DO NOT POST ITEMS BACK IN THE RED POST BOX AS IT WILL ARRIVE TO US LATE AND YOU WILL BE ISSUED LATE FEES.

Shipping Details

Delivery Australia wide is available and the shipping method will be the choice of Rent My Dress Pty Ltd. Your delivery can be delivered to you up to 6pm on the requested day of delivery or earlier. WARNING: If you are unavailable to sign for this delivery it may be taken back to the depot or post office for collection by you. It is your responsibility to be available for delivery of your item/s or collection of your item when you have not been available. Your rental period starts from the time the courier attempted first delivery and credits will not be issued for late delivery where you have not been available to accept delivery. If postage delays are outside our control (mutually) we agree that you and Rent My Dress Pty Ltd will not be accountable and a store credit will be issued. 

Dry Cleaning

We dry clean and inspect all products with the utmost of care however use of this product is at your own risk and Your Closet shall not be held liable for any health-related complaints associated with a product rented from our site. Our products have been worn by other consumers prior to your rental.

With the delivery of your product, pre-paid return packaging is provided. Please ensure that you place your dress inside the self-addressed envelope and return the envelope to Australia Post by 4pm on the last day of your rental. Rent My Dress Pty Ltd will not take responsibility for lost articles mailed in Australia post boxes. If you lose your return packaging it is your responsibility to return the garment via trackable express post to Rent My Dress Pty Ltd. You must provide tracking details to @rentmydressaus on Instagram in order to avoid further borrowing charges.

If you return your dress via an Australia Post Outlet (highly recommended) where it will be scanned over the counter as proof of lodgement then the article will be deemed as returned and we will accept responsibility for the article after the first scan. If you return your dress via an Australia Post Box and the dress is not scanned and is lost by Australia Post then you accept responsibility for this loss and will be required to pay the retail cost of the dress less the rental fee already paid. 

Once delivery has been made to your nominated address you bear all responsibility for your product. If you have opted to have your product delivered to your work address of mailroom, responsibility is passed to you as soon as the mailroom has signed for the product. A secure shipping address is highly recommended when placing your order. In the event that an unsecured shipping address is provided Rent My Dress Pty Ltd does not bear any responsibility for the product left unattended. If you are unavailable to receive the item Rent My Dress Pty Ltd will not be held responsible for additional shipping delays or additional shipping charged passed on by delivery service.

Use of Rent My Dress Pty Ltd products

You agree to treat our products like you would your own. You will treat the garment with the utmost of care. You will not attempt to fit into a dress that is too small for you, you will not try and zip up a dress that is too tight and therefore damage the zip. You are responsible for any damage to the dress due to fire, major stains, theft or loss. Normal wear and tear is considered minor stains which can be removed in dry cleaning, small seam rips, missing beads and sequins, stuck zippers. If you return a product and it is damaged beyond normal wear and tear then you agree that we shall charge you, and you will pay, for the price of repairing the product or if the product is unable to be repaired you agree to pay up to the full retail value of the dress. This price will be at the Discretion of Rent My Dress Pty Ltd.

Return of Products on Time

You agree to return your product on the order return date (or next business day) by 4pm using the prepaid return envelope provided.  If you return your product late you will incur a fifty ($50.00) late fee for every day you are late up to 100% of the retail value of the dress at the discretion of Rent My Dress Pty Ltd. You agree to pay these late fees up to an amount not exceeding 100% of the retail value of the products. Late fee is payable regardless of whether a customer is a member or has used credit for their order. If you have not returned your product within 20 days of the return date your product will be considered a non-return and Rent My Dress Pty Ltd will demand payment for the maximum late fee as set above, less any late fee we have already charged you. If you lose your packaging it is your responsibility to return the product to Rent My Dress Pty Ltd within one (1) business day of return date. You must purchase return shipping at your own expense and provide the tracking number to Rent My Dress Pty Ltd. Rent My Dress Pty Ltd will not be held liable for products that are late or lost in transit due to your chosen method of shipping.

IF WE DO NOT RECEIVE BACK THE DRESS AT ALL YOU WILL HAVE TO PAY THE FULL PRICE OF THE DRESS  

Collection

If you do not pay the amounts owed to us when due we will pass on the invoices to a collection company to pursue you for collections, including and without limitation attorney and collection fees.  Rent My Dress Pty Ltd reserves the right to terminate your right to rent products from us at any time at our own discretion should you breach this agreement or for any other reason.

Insurance

Normal wear and tear encompass minor stains, rips, missing beads, stuck zippers or other minor damage covered by the insurance you paid for with your rental of the applicable Product. If you return a Product that is damaged beyond normal wear and tear, then you agree that we shall charge you, and you shall pay, for the price for repairing or replacing the Product, as determined in our discretion, up to the Retail Value for the Product.

 

Cancellation Policy

Hire fees are non-refundable. If you cancel your hire and give us one week or more's notice, then we can happily issue you a credit note to be used within 12 months from the date of cancellation. 

 

 

Fit

If the dress is not your perfect size, we will try our endeavour to send an alternative style or size (subject to availability) and courier service availability (must be within the Express network and dependent on a confirmation from Australia Post). If we are unable for whatever reason to send an alternative size or style a merchandise credit will be issued for the customer to the value of the rental.
